Second Conviction

  • 3 year license suspension

  • Likely more jail time

  • Minimum fine of $1,500

  • Probation

Third Conviction

  • Class C Felony with a maximum term of imprisonment of 5 years, fine of $125,000, or both

  • Mandatory minimum jail sentence of 90 days

  • Minimum fine of $2,060

  • DMV license revocation for life

Washington

First Conviction

  1. BAC less than .15% OR no test result

    1. 24 hrs jail or 15 day EHM, 90 day license suspension, 1 year IID, andprobation

  2. BAC .15% or higher OR test refusal

    1. 48 hrs jail or 30 day EHM, 1-2 year license suspension, 1 year IID, and probation

Second Conviction

  1. BAC less than .15% OR no test result

    1. 30 day jail, 60 day EHD, 2 year license suspension, possible 5 year IID, and probation

  2. BAC .15% or higher OR test refusal

    1. 45 days jail, 90 day EHD, 3 year license suspension, possible 5 year IID, and probation

Third Conviction

  1. BAC less than .15% OR no test result

    1. 90 day jail, 120 day EHD, 3 year license suspension, possible 10 year IID, and probation

  2. BAC .15% or higher OR test refusal

    1. 120 days jail, 150 day EHD, 4 year license suspension, possible 10 year IID, and probation
