What Do Oregon & Washington Laws Say About Stalking?

Oregon and Washington have laws that criminalize stalking. Oregon’s laws define stalking as knowingly alarming or coercing another person through “repeated and unwanted contact.” It must be “objectively reasonable” that this contact would cause the victim to fear their safety or the safety of their immediate family. These cases often involve allegations of following, monitoring, or repeated communication.

In Washington, stalking is similarly defined. The law specifically lists repeated harassment, following, contact, and monitoring as acts of stalking

In both states, stalking allegations frequently intersect with protective or restraining orders, and a violation of those orders can lead to additional criminal charges.

Penalties for a Stalking Conviction

The penalties for stalking are severe across the board, regardless of whether it’s a misdemeanor or felony. However, the exact consequences will depend on a case’s circumstances, whether protective orders are involved, and the defendant’s criminal history. 

In Oregon, stalking by itself is a Class A misdemeanor, which can come with a jail sentence of up to 364 days. The penalties are more severe for those who violate a protective order or have already been convicted of stalking. In these cases, the offense is classified as a Class C felony and can be punished by up to five years in prison.
