How Oregon & Washington Define Assault

Oregon law recognizes four degrees of assault, ranging from misdemeanor offenses to serious felonies:

Fourth-degree assault – A Class A misdemeanor. This is the least severe charge and typically involves “intentionally, knowingly, or recklessly [causing] physical injury to another.”
Third-degree assault – A Class C felony, carrying up to five years in prison and fines up to $125,000.
Second-degree assault – A Class B felony and a Measure 11 offense. This charge carries a mandatory minimum sentence of 70 months in prison.
First-degree assault – A Class A felony and a Measure 11 offense. This is the most serious assault charge in Oregon, carrying a mandatory minimum of 90 months in prison.

Washington also divides assault into four degrees:

Fourth-degree assault – A gross misdemeanor and the least severe classification.
Third-degree assault – A Class C felony carrying a sentence of up to five years.
Second-degree assault – A Class B felony, punishable by up to 10 years in prison.
First-degree assault – A Class A felony carrying a sentence of 20 years or more in prison.

What Can Increase the Severity of a Charge?

In both states, certain factors can elevate the charge or the penalties you face. These include the use of a deadly weapon, the seriousness of the alleged victim's injuries, and the identity of the alleged victim. Prior criminal history can also significantly increase sentencing.
